Diddy’s lawyers claim rights violated in cell search

Sean “Diddy” Combs’ lawyers assert that a recent search of the music tycoon’s prison cell infringed upon his attorney-client privilege.

Diddy, aged 55, is currently in prison at Brooklyn’s Metropolitan Detention Center as he waits for trial on federal sex trafficking charges. After a legal motion on Friday, November 15, alleged that Diddy attempted to interfere with an investigation by reaching out to witnesses while in jail, Diddy’s attorneys responded.

“Defense counsel has recently learned that the prosecutors are in possession of attorney client privileged material, including the defendant’s own written notes. This search and seizure are in violation of Mr. Combs’ Fourth, Fifth and Sixth Amendment rights,” Attorney Marc Agnifilo, acting as the lead representative, made his case in a letter submitted on Monday, November 18.

According to court papers obtained by US Weekly, Agnifilo requested an “urgent evidentiary hearing” from Judge Arun Subramanian to look into the search, which he referred to as a “targeted seizure” that constitutes a breach of “substantive due process violation.” He asked for an investigation into  “who authorized a search of Mr. Combs’ sleeping area, personal effects and paperwork” and “who determined what paperwork” be delivered to the United States Attorney’s Office.

Agnifilo also stated that Diddy’s lawyers did not know about the musician’s written notes being taken from his cell and given to prosecutors until the prosecution filed a motion on Friday alleging that Diddy tried to influence his trial. In Friday’s legal filing, prosecutors referenced a review of recorded calls made by Diddy, stating that the rapper broke jail rules by making numerous calls and texts using phone accounts of other inmates.

Documents at the Court Stated

“Since the defendant has been detained at MDC, he has continued to try to evade law enforcement monitoring, corruptly influence witness testimony, and further attack the integrity of these proceedings,” the documents from the court, acquired by CNN, stated. “While attempting to evade law enforcement monitoring, the defendant has, among other things, orchestrated social media campaigns that are, in his own words, aimed at tainting the jury pool; made efforts to publicly leak materials he views as helpful to his case; and contacted witnesses through third parties.”

Accusations on the Rapper

Diddy was taken into custody in September and accused of sex trafficking, racketeering, conspiracy, and transporting individuals for prostitution. He was accused in a 14-page indictment of organizing sophisticated and scripted sexual shows named “Freak Offs” and was charged with using intimidation and coercion to make victims participate in lengthy sexual activities with male sex workers.

Diddy entered a plea of not guilty and refuted the allegations brought against him. He has been rejected bail on three occasions. During the latest court proceedings, the prosecution accused Diddy of trying to improperly influence the trial’s outcome in order to justify their opposition to his fourth bail request.

Earlier this month, Diddy and his lawyers suggested a new bail package of $50 million, contending that he should be granted the opportunity to get ready for his trial in May 2025 outside of prison because of altered circumstances and fresh evidence. The report suggested a bail package that is much stronger, including home confinement, 24/7 security surveillance and limitations on Diddy’s communication with anyone other than his lawyers. There is no decision yet on the fourth bail request.
